Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 7 of the Terms of Employment (Information) Act, 1994 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

1: Summary of Complainant’s Case:

The Complainant in his Application/ Claim referral form to the Workplace Relations Commission outlined a number of issues that he had in dispute with the Respondent. However he did not attend the Oral hearing to present his case.

Accordingly his written evidence could not be tested by the Adjudication Officer or subject to cross examination by the Respondent.

2: Summary of Respondent’s Case:

As the Complainant did not attend the Oral Hearing no evidence was called from the Respondent.

3: Findings and Conclusions:

As the Complainant did not attend the Oral Hearing (and was properly notified) the case is dismissed for want of prosecution.

4: Decision:

Section 41 of the Workplace Relations Act 2015 and Section 7 of the Terms of Employment (Information) Act, 1994 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions of the cited Acts.
